The 22nd Annual IPLJ Symposium

On Friday, November 8, 2013, the Fordham Intellectual Property, Media, and Entertainment Law Journal (IPLJ), in conjunction with the Fordham Intellectual Property Law Institute, will present a series of panel discussions on recent developments across IP practice areas.

The day will begin with the Patent panel, which will cover the most recent major Supreme Court decisions – AMP v. Myriad Genetics, FTC v. Actavis, and Bowman v. Monsanto Co. The talks and discussion will focus on what these opinions tell us about the Supreme Court, what will be the repercussions in the Federal Circuit and district courts, and whether Congress will get involved. In addition, the session will cover the recent grant of certiorari by the Supreme Court in two patent cases concerning the respective roles of District Courts and the Federal Circuit in determining what are "exceptional" cases for the award of attorneys fees.

The second panel will cover key recent developments in trademarks, both in the case law and in the TTAB. It will also provide an update on what the United States Patent and Trademark Office is doing with regard to trademarks. The third and final panel will discuss fair use in copyright law, specifically the important recent developments in the Second and Ninth Circuits with regard to transformative uses. The panel will also discuss the Supreme Court’s recent grant of certiorari in Petrella v. MGM regarding the defense of laches.

Academics, practitioners and government officials will present and discuss their views. There will be ample time for questions and contributions from the audience.
